On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. If one has Green Card based on family preference (son of US citizen), how long he has to stay in USA to maintain his Green Card. I heard it is min 180 days in a year ? Is that correct ?
What are other restrictions ? Does it impact citizeship ?
A detailed answer would be very helpful.
Also If one has Green Card which one if faster router to get his spouse to USA:
1. Applying as daughter in law of US Citizens. Or
(what family preference catergory this is ?)
2. Applying as wife of person having Green Card
(what family preference catergory this is ?)

I am Aug 07 filer , I was not able to submit my medicals with my I-485 application .
I got my medicals done with civil surgeon in sept 2007 and was waiting for RFE to submit the sealed cover . I never got a RFE but I got a interview at local office next month .
So can I submit the sealed cover that the civil surgeon filled in 2007 or do I need to get all the tests done again now and fill a new form .

My wife did not have SSN when her FP was done. I would not suggest writing ITIN either.
But must write the A# from FP notice onto the form.
But I believe my wife used her ITIN# in place of SSN in some other GC related forms , Is this going to be an Issue??

My PD is Oct 2004. LC filed in TR. Should I push my company to file convert the case to RIR? How much time does is take? How much time does it take to file for 1-140 and get it in premium processing?

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. I'm moving my exhaustion projection date back a week. My target is based on a rolling four week usage average so variations from week to week are discounted. I want to consult an employment/labor lawyer with regards to an employment agreement that I have signed with a desi consulting company in US. They have sponsored an H1b for me which I am yet to get stamped. I am in India right now and wanted to talk to a Labor lawyer who could tell me the effects of not joining this employer given that there are certain terms and conditions stated in the agreement. Could you suggest me some law firm in US where one can speak to a lawyer on the phone for a reasonable amount of money and seek legal advice.

The H-1B system is clearly out-of-sync with the real world. Persons who qualify for �cap-subject� H-1Bs are allowed to apply starting April 1st each year, but can not start working until October 1st, six months later. Hi,
I am planning to travel to Indian in coming months. However, I have a stright outright dismissed CMIT case back in 2007. I got the non convincted case expunged. I got FBI finger print results and they say no records were found. I got BCI from state which states no records were found. Last time , I travelled abroad was in 2006. I have a valid AP.
Do you see any risk of re entrying US on AP?.
Your help is much appreciated as I have to have to be there in India.

If you have receipt # you can check the status on uscis.gov, you can also call their 1-800 # to check what's going on with this application.
