Hi,
I have an F1 visa that expires on July 11'th 2009.
I am currently on OPT and working. My OPT lasts for another 10 months.
I have just got my H1B application approved in the latest round and am allowed to get it stamped only after October. Therefore between July 11'th (end of F1 visa) and October (stamping of H1), I will be in the US without a valid visa but with a valid OPT.
I need to go to India in June and return on July 10'th- 1 day before F1 visa expires. Am I allowed to re-enter the US with 1 day of visa validity? What documents do I need to carry with me? How should I show them that my H1B is approved and will be stamped in October?
Will they let me back into the country knowing that starting 1 day later I will be without a valid visa until I travel outside the country in October to get my H1B stamped?

I just received an 3 year h1-B extension based on an approved I-140. I had only 2 years left of 6 year h1 limit but because I have an approved I-140, I got one more year.
I attached my approved I-140 copies along with H1B extension application but the Alien number A# on this new H1-B extension approval is different than what I have on I-140 approval notice. Actually its a typo, instead of A 08 it A 008 and because of one extra zero the last digit is lost.
Is this a matter of concern? Please help.

HI,
I have an H1b approval notice but as it clear the duration of the visa validity starts in October, today being 27 june and three months away from start of visa duration can i travel to India next month ( july) and be back in August as i am still on OPT and working full time in America now. I have got an oppointment with a consulate in India. Once i have got a stamp on my passport will i be permitted to enter back immediately or only in october, i need to make decision to travel now or later as if i am allowed back immediately it will affect my work.

Hi,
I'm GC holder and i've applied for reentry permit and the validity is 2 yrs.
I've been living in INDIA for the past 10 months and now i want to go back to US.
I'd been filing my taxes and all but was not working for any US company for the past 10 months.
Will there be any issues at the POE when i return to US?..Usually POE officer asks the questions like where do you work and what was the reason you went to INDIA..
Is it Ok to tell the officer that i'm not working?
Please share your thoughts

I had a H1b visa but never travelled to US.My visa got cancelled without prejudice when i left the organization.My new employer filed l1b individual on my behalf.i129 was denied by uscis stating that i am a skilled worker but do not possess specialized knowledge.Moreover the position in US is that of a software engineer & does not require any specialized knowledge.Please note that I hold a Bachelor of Engineering degree(BE) in Electronics & Telecommunications with about 5 years of IT experience.

Hi All,
Today I received an email from CRIS saying that they have sent me an RFE on my AP application. My wife's AP was approved last week, so it really confuses me about what this could be about? Can anyone shed more light on "probable" causes of I-131 RFE?
I have another question - my passport is expiring in November 2007. Could that be the cause of the AP RFE? I could get that renewed from Indian embassy in 10 days, so its not a problem. But, has anyone heard about cases where expiring passport causes RFEs?

LC was approved in 08-20-07 but I-140 was not filed within 180 days according to new rules. has any body have this problem? will DOL or USCIS let it slip. please help.

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).

Hey everybody, My friend have a situation. He is from Haiti and he been in the USA since 1998 on a visitors visa but stayed. Graduated school, but couldn't do nothing else because of his papers, he lived with his sisters and they didn't work on it. Had a little situation in 2007 where he left the scene of an accident because he didn't have papers. They called it a felony, and now the (TPS) came around and he got denied because of that felony. He doesn't know where or what to do, don't have money for lawyers because he cant work. Anybody out there been there that knows what to do please feel free to do so. GOD bless
