I just spoke with Chris Nutall of FT who did the interview with Craig Barrett. I've also forwarded Berkeleybee's newest IV ppt and the IV flyer to him.

Here are my details
1) 3 Years Bachelor degrees (B.Sc) in science from Andhra University,India
2) 2 Years Masters degree in science (M.Sc), Andhra University,India
3) Having 9 years of continuous software experience (prior to present employer)
Am I eligible to file Perm Labor under EB2 category?
The job with my company is EB2 eligible (Requirement is Bachelors degree and 7 years experience).
As per my education evaluation (done some time back for H1B), mentioned that my above 2 degrees are equivalent to Bachelors degree of science (BS) in USA.
Please provide your valuable suggestions/advices.
Thanks in advance.

Hello friends
I am thinking of taking these semester off because of my health issue
I had decided to attend classes and booked my ticket in April to my country. I am an international student
So I was thinking how many months I can stay in USA after I take a semester break
Also if I take these spring break off and than the summer break is off by default so will it be a problem if I am not in status for 7 months?
Please let me know

Congrats to President Obama on his first 100 days in office. And well done on keeping immigration reform on the front burner. During his prime time press conference last night, the President had this to say about immigration reform: Okay. Lori Montenegro. Q: Thank you, Mr. President. Mr. President, when you met with the Hispanic caucus a few weeks ago, reports came out that the White House was planning to have a forum to talk about immigration and bring it to the forefront. Going forward, my question is, what is your strategy to try to have immigration reform? And are...

Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

My wife switched from H4 to F1 status and is near completion of her Masters degree.
She will be traveling to India soon and will be getting her F1 visa stamped.
Documents/advice from anyone who has done this recently will be appreciated.
welcome any suggestions/pointers in this regard.

I read this in the I-485 application:
"The check or money order should be made payable to the Department of
Homeland Security except:
--If you live in the U.S. Virgin Islands and are filing this
application freely, make your check or money order
payable to the ''Commissioner of Finance of the Virgin
Islands.''
--If you live in Guam and are filing this application there,
make your check or money order payable to the
''Treasurer, Guam.''
Good luck in re-filing!
Should the check made out to "Department of Homeland Security"?
Should the checks stapled with each form (485, 131, 765) or kept on top of the packet?

From Greg Siskind's blog:
In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesnt explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

As per this link
http://www.travel.state.gov/pdf/FY07AnnualReportTableVp2.pdf
Foreign State 1st 2nd 3rd 3rd Other Workers 3rd Total 4th 4th Certain Religious Workers 4th Total
India 2,855 6,203 17,795 190 17,985 278 79 357
I see that India got around 27400 Gcs. Does it mean spill over was happening during FY 2007? I was under the impression it started since FY 2008.
Correct me If I am wrong ?
Infact I am waiting for FY 2008 stats now. Wanna see how much spill over we got.

A RFE is not related to the type of processing (regular / PP) but depends on how well the petition was prepared.

One of my friend got their Fingerprinting letter and the last name is misspelled. What should they do go ahead and take it to the FP office or call USCIS and get it corrected.
Anyone in similar sitaution? Please advise.

Hi!. I am helping my brother for his PERM. He has a BS Electrical Engineering in the Philippines. Is there a requirement to get an education equivalency assessment for PERM? Does he need to have a US Electrical Engineering license as a support for PERM as well?
He has not yet started yet. We are still studying several options. He also has 7 years experience in the Philippines. Can that BS +7 years outside the US count for EB2 PERM?
Thanks.
