I am in the process of applying for the green card but as the labor department was delayed to send the paperwork by status became out of status, my lawyer suggested me to go back to my country apply for H1B visa and come back. That is why I want to apply for H1B visa . My lawyer tells me that there is no way I can get an approval if my company doesnt show tax return documents for the last 2 years. Is it true or there is another way or documentation which could be used in order to apply for the visa? My boss doesnt want to show the tax returns but accepts to show a bank account and different type of paperwork such as franchise agreements or certificates.

Can you please let me know if my lawyer suggests me the righ way if not which woudl be the best way to continue my green card process and get a result as soon as possible.

Hi,

I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:

Part E. Attorney of Agent Information
16. Law firm/Business FEIN:

This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.

If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.

I am having a problem and dont know where to start on this one, my experience in c# programming is average and was hoping for some advice on this subject. I have a disc image (an exact duplicate of a 40gb hard disc drive) the format is a dd image.

My task requires me to programmatically read through the files on this image, compare file extensions and recognise certain file types on the drive. Is this possible? I cannot find anyone who has attempted this on the internet and would appreciate any guidance to get the ball rolling.

On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.

Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.

If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.

Hello
I'm A medical student who has come to do a 1 month internship(Clinical Elective) at a University on a F-1 visa valid till mid may 2009 .My internship here ends at the end of march. I have also 2 internships(cliinical electives) scheduled for the month of May and June as well at ANother University . The main problem is that the other univ require me to be on a B-1 and not on a F-1 . My present school has called them and requested them but they rejected the plea. They want me on B-1 . Now my question is that "Can I change my status from a F-1 to a B-1 while in US" - I have a valid visa which is not yet expired .

It would be appreciated if u can tell me about the forms that I shall need to fill in for the same ? Do I need to hire an attorney for it ?

Currently I�m holding h1 and same time has AOS with my existing employer. I�m continuing my employment based on h1 and use Advance parole for travel purpose. My employer mentioned about not revoking I-140, even if I move to new employer. Since with new client, I�m transferring my H1 visa, I have 2 options with regard to my AOS portability

1) Either just transfers my h1 without porting AOS with new client. Continue with my AOS with old employer, since he won�t revoke my I-140 and provide support for future employment.

2) H1 transfer and Porting my AOS with new client and it does require my job and description mentioned in I-140 matches with current offer.

I would really appreciate, if you provide your valuable suggestion/recommendation. The best option to go ahead with.

Applying for SSN doesn't invalidates your H1..

I received my EAD recently and shortly applied and got SSN. Its a card which allows you to work. Doesnt cancel nothing :D

I got H1 in 2008.
I want to that till how much time is the petition valid , if I dont go for stamping.

Also , suppose my company withdraws the petition, so now till how much duration my cap number is valid?

Expiration date will be mentioned on I-797 approval notice
you will be counted only once against cap. and you can be on H1/L1 for total of 6 years (without a break) - ofcourse assumption is that you never file for a GC

I have the following situation.
I got married in June 2009 and my wife had a Business visa and she had travelled once. After our marriage, she travelled on her Business visa again in July for three months till October end 2009.
I have a H1 valid till June mid 2010 and when I tried to process her H4, many people said that, since the duration left in my visa is very less, chances of rejection are higher.
On her Visa, it is written as B1 / B2.

So it would be helpful for me to know, if she can travel on her business visa as a visitor [her visa has B1 / B2]. If she has to travel, does she need a letter from her company or do I have to provide the documents whereby I show that, I can take care of her in US.

If there is any other way, please let me know.

I got an LUD on my I140 on 07/28/07. There is no message change though. This I-140 was approved way back in Aug 2006. I have filed my I-485 etc on June 1st 07, and its in process. Does anyone know what doesn this LUD mean.

This reporter has got it right. The U.S. is obsessed with importing poverty from poor non-assimilated immigrants (mostly illegal) and shunning high-skilled immigrants who assimilate and increase the country's living standards. I am panning to file I 485 before July 31st. Also I am planning to go on vacation to India around Aug 10th. The trip to India is unavoidable.

Experts please answer the following question:

1) Both me and my wife are on H1 and it has to be stamped. Will I 485 Filing have any adverse impact on the H1 Stamping ?

2) Will leaving the country for vacation without the I 485 receipt have any impact on the I 485 process.
