Hi all,
I had my h1 issued in nov '09 and was laid off from the company in march '10. However, I was able to secure other position in the same company a month later. But now the company wants me to exit/re-enter the country (and get my visa stamped) before starting the new position.
Since I was technically out of status for the month of April (and don't have any paystubs for the same), will it be difficult to get my h1 visa stamped? Also, can I get my stamping done in Canada, or will I have to my home country?

I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.
My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

Hello All,
I'm in a big fix now, need immediate suggestion and help.
I have a valid H1B petition filed from SC, now I had moved to FL and started working on a prj. I have planned for my trip to india early june and then I came to know from my lawyer that I need to have a new LCA and H1B amendment before traveling to india and appearing for visa interview.
They had already filed for my new LCA which I have got and they had applied for my H1B premium amendment also but I haven't got the new petition yet.
I have applied for the visa interview by filling all the DS-160 forms for my family based on old petition number.
Can I can still go ahead with the interview and carry the new amended petition in my hand OR should I cancel the existing interview and once again fill the new DS-160 forms and take the new interview date ?
Please let me know on this....

My wife got H1B approved in this year cap with validity date from October 1 2009. She is going to India for vacation during August 2009 and planning to go for H1B stamping.
My question is, whether she can go for stamping before October 1, 2009 which is the start date mentioned in I797 or she should go for stamping only after October 1,2009 ??

Robert Creamer has an interesting analysis of how the ruling in Arizona could affect the Democrats' prospects in November. Many pundits are assuming that Republicans benefit. But Creamer makes a point I've said here many times. The only voters who switch their votes on the immigration issue are Hispanics. Anti-immigrants NEVER vote for the Democrats anyway. They almost always have a host of issues that they care about and in most cases the GOP is the better fit for those voters. So Democrats who try and pander to the Tea Party types are wasting their time.

Well this came out of nowhere. Last night the Senate passed an emergency border enforcement bill that provides $600 million for increased security on the southern US border. The $600 million will come from raising fees on staffing companies. The fee will increase by $2250 for each L-1 visa application for companies that employ 50 or more workers if 50% of the workforce is on an H-1B or an L-1. The LA Times reports on the Nevada governor's race which has Latino Brian Sandoval seeking to become the next Republican governor of the state. Sandoval has risked alienating his Latino base by endorsing the Arizona law and tougher drivers license rules. The GOP is hoping that Latino voters will vote for someone who looks like them even if he or she supports policies that are the polar opposite of what they believe. I doubt very much that will happen. Voters vote their interests first and then may look at a person's ethnicity if two candidates are similar in their views....

My aunt (father�s sister) is separated (not divorced) from her husband for over 17 years now. She and her 24 year old son (who was 7 years old when his parents separated) live with our family for last 17 years. Her application for visitor visa was rejected in year 2003 when I had invited her to attend my graduation ceremony. At that time I had not sent a sponsor letter. I have invited her to visit me again and this time I am sponsoring for her visit. She owns a house in India and her son owns a business.
Would her marital status (separated but not divorced) create any issues during the interview?

A new poll from ABC News shows a seemingly contradictory result. Nearly six in ten support the controversial Arizona law SB1070. That will make the Tea Party crowd happy.
