I am assuming that EB2 India will have a cut-off date of atleast June 2006 for Aug as well as Sep. The time window of approvals is Aug 1 2008 to Sep 30 2008. In this time frame, they will have to pull the files from shelves and make them ready for adjudication.
I also remember from I-485 field SOP, that first step is to contact US Consulate abroad where you filled your DS-156 if you traveled within last 12 months for any discrepancy. This step itself can take a long time.
Then there are a lot of people who had PD current but they haven't done finger-printing yet. Imagine time required to schedule fingerprints, appear for one, and then get the results.
Just my thoughts.

When exactly did you submit your application? I just called a few minutes ago to ask about mine (which was submitted early May) and the guy said I should not be affected by this as I should already be well into "the process by now" meaning I should have already been assigned a visa. He spoke very very slow...so I don't know if he was 100% sure of what he was saying:confused:

Same here ... for EAD and AP (for me or dependent) my company does not reimburse these fees. They will however reimburse if I have to use EAD to work due to unavoidable H1 extension issues/ inability to extend beyond 6 yrs etc. I think that is a fair and reasonable policy in general
I know they charge a lot, but my employer will pay them higher fees but my employer will not pay me filing fees.

sorry but this is ridiculous. If the US has a skill shortage and wants foreign workers, it should ensure that the foreign worker and his/her family are given the same rights that a domestic workers family enjoys.
If they can't give that right, why do they want to invite the foreign worker at all?
Its true that they are not forcing this on us and we are free to go back anytime. But still isn't the inequality pretty clear here? and this country is supposed to be all about equality...
I agree with you. This policy basically amounts to treating "skilled labor" as some inanimate robots with no emotions or needs whatsoever. If H4 folks are free-loaders, then so are the dependents of EB green card holders .. after all the dependents didnt go through labor cert, did they ? As for the equality hogwash, I have long stopped believing that .. it exists only technically; but reality is what is staring us right now .. retrogression for coming countries with large number of skilled people, backlog "elimination" centers and infinite waits to be given any meaningful rights. Why ? simply because we were idiotic enough to believe all this "meritocracy" and "equality" propaganda.

True, but Airline CAN give some 'guarantee' to get the transit visa for passengers. I flew Singapore Airline, and they arrange transit passenger to take a tour of the city, if the stopover is , i guess, more then 3 or 4 hrs.

Lawyers can't be trusted in immgration area ... I wrote in the other post too.
Could you ask him for a PROOF and that the package actually reached there and USCIS actually rejected it without opening ??

I got an email from my law firm, that my packet was refused to be accepted by USCIS.
I received the email from my law firm (Monday night - July 2) that:
Please note however your case was sent to Nebraska last night and did arrive - we tried!
Which means mine was sent or reached NSC sunday night or must have been hand delievered early Mon morning. Don't know exactly what happened. I just trust them!!!!
I didn't bother to ask my law firm further details. I will ping them first thing monday morning and try to give any update I get. I hope they have some proof of the refusal!!!!!!!............

Berry Scheniderman, Virginia. Horrible experience. They took 3 months to file for my H1B extension and then I was running out of time so I had to get it converted to premium processing. They simply sit on the case.
Alan Heckler, (Specially the paralegal named Cathy)., takes months to respond . The only thing they are quick are at getting money. Totally unresponsive.
Under current, LLC in Chicago , takes weeks to see the paperwork that you send and weeks to process them

EB3 porting is a loophole like labor substitution.
when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.
Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.
How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

:eek: I am not sure whether it is my HR to be blamed or my corporate law firm TheChugh who has been handling my case, no one has bothered to convey my PERM status or even my case #. I feel frustrated when my HR doesn't respond about the status.
I understand that they must by flooded with application preparation but setting up a link for me to check the status shouldn't be very difficult.
I really hope that my PERM gets approved before 31st July so that I can file I-140 and I-485 concurrently.
Anyone else has experience to share about TheChugh law firm?

FRAGOMEN SUCKS TOTALLY - but unfortunately I got no choice - my employer uses these morons for immigration services. My reasoning is based on my experiences below:
1. I have been mailing Fragomen for 3 MONTHS (YES THREE FULL MONTHS) to initiate my H1 extn 6 months prior to my visa expiry cause I had a need to travel outside the US in a short notice and I did not want to be stuck because of me not having my visa extn papers in time. Despite 5 e-mails and 5 voice mails - there was no response from FRAGOMEN. Escalated this with my company and we had a conference call to discuss this issue with Fragomen. Guess what FRAGOMEN's Client Service Manager had to say when I asked her about they not answering my e-mails and voice mails for 3 months - "I CANNOT ANSWER THIS QUESTION SINCE EVERYCASE IS DEALT DIFFERENTLY AND WE DECIDED TO INITIATE UR H1 EXTN 3 MONTH PRIOR TO UR VISA EXPIRY." WTF!!! Who the hell are they to decide on my professional/personal travel needs? I really wish I had their job - do nothing at all and when questioned say "I cannot answer that question".
2. To make sure FRAGOMEN do not mess up my 485 as well, I asked them in the same call the time they would take to process and file my 485. The client service manager promised me that they would file my AOS in 4 business days from the day they receive all the documents from me. I made sure I sent all the documents including Medical Exam results in less than 2 days from the day we had this call. Guess how long they took to file my case - 3 full weeks - 15 business days!!!!
For the kind of money they charge, the service is totally bad. FRA-DON'T-GO-MEN might be a better name these guys.

I have same question. I filed I-485+AP+EAD in July fiasco, after one year renewed I-131 (paid the fee then). I remember from that time that I do not have to pay the fee again to renew it. But in the e-file form I am not seeing option to get the waiver. Now I am doubting whether 2nd renewal is free or not?

Commercial airlines fly between 25,000 ft and 40,000 ft. Airlines generally take risks for profits. I know it. Some airlines like United are ultra sensitive to turbulence. Some fly right through turbulence. And sometimes I feel some pilots are plain incompetent, they have no control over aircraft during the storm.
I have personally taken 500+ flights, almost 2 every week. And I can say, I get really nervous when turbulence or strong clouds are present. You are one second away from the big one. Always always wear seat belt during turbulence, if it gets severe, you will hit the head on the ceiling. The turbulence during take off and landing is usually more risky as aircraft is closer to ground and can not afford to lose altitude. If it is at a higher altitude, aircraft can lose some altitude, due to "air pockets" and still be ok.
