My Certified Mail to Ombudsman was actually delivered at DC on Sep 2nd 7:52 AM. Today is Sep 16th , so far no reply.
Will keep you updated if anything happens to my 140 - Anyone else need any help sending 7001 to Ombudsman ?

I received a letter from Ombudsman's office last week (1 month after I sent them Form 7001) informing that they have initiated an inquiry with USCIS and will get back to me within 45 days. Will keep you posted if I receive any response.

They have already moved to Title 3 of the markup really quickly (and I mean REALLY QUICKLY). Hopefully they will move past Title 3 soon too and get onto Title 4 and 5 hopefully on Wed.

GCTest: Is it also possible, as part of ur consultation, to see if once a person files in EB category he should NOT be allowed to marry citizen or person from current countries and thus be able to use FB etc...or other means... Or is your irritation only for EB2 category?

I am not sure if USCIS will move beyond April 2004 until Jan 2009 due to the holidays and election and as someone said they want to take it easy. Even if they move the dates it does'nt help unless they approve cases with certain process in place.

Rather I would like to add more items to what u have listed-
1. Its wrong for EB2 filers to find/marry a us citizen. That will be unethical of them to do as they will be jumping lines. Because u would be unable to do if u would have married non-citizen..so based on GCTest's logic please dont marry us citizen or if u have marriued continue to only use you EB2 application for processing :-)
2. Also people who are now planning of using EB5 (assuming u have now saved/gather enough money). So EB2, EB3 or other people u have been saving money and are now thinking of risking ur money/career/life on EB5 filing..please dont do that...because that will be unethical.....u r doing it bcos u now have money. Per GCTest's logic u did not having money u filed ur EB2 or EB3 application so if u have money now...dont try to use it.

Urgent- Please help I-485 issue
I filed for I-485 for my son on 2nd July but did not receive the receipt so far. My son is turning 21 next month, my lawyer is guiding me to file for F-1 for my son to be on the safe side. Is filing for F-1 going to effect the I-485. What will happen if approved F-1 comes before receipt?
Anyone can help me with this issue?

My application was finally approved yesterday after almost 7 years in queue. Here is the sequence of events right before the approval.
RFE email on 02/13/09
2nd Biometrics Notice received on 02/17/09
Lawyer receives RFE for EVL, EAD cards and Marriage Certificate on 02/24/09
Completed Code 3 Biometrics on 02/26/09
Soft LUD immediately after Biometrics on 02/26/09
USCIS receives RFE reply on 02/27/09, Hard LUD and email on the same day

This the time to unite rather than giving up.
Beware of HR 5924, this bill is planning to set aside 20k EB3 visa's for nurses instead of the current 10K. If EB3 folks loose focus and fail to push for recapture bill and somehow HR 5924 is passed. EB3 will be doomed.
Getting HR 5882 / S 3414 (recapture bills) through congress is the only hope for EB3's.
Changing the spillover will not help EBI because in both the spillover interpretations EB3I is the last in the chain. The only reason EB3I benefited from earlier spillover interpretations was because there weren't any ripe EB2-I cases available and it spilled over to EB3I. Reverting to the old spillover interpretation will not benefit EBI but sure it will benefit EB3-ROW.
Let us focus on getting the recapture bills through. Call u'r congressman/senator and start pushing for the recapture bill. EB3I has been benefited until now because of the AC21 recapture. Now it is time for another recapture.

i dont get it..why r folks so happy...i agree its current till 06..but that does not mean that people are goin to get green cards...it just means that till 06 whoever had not got a chance to apply for 485 can now apply...congrats to them...but i beleive there are not many people like that..

People, since Aman and lets not forget other core members also (who I am sure have racked up a lot of out of pocket cost) we as a community should gather funds for administrative cost also. GC is not just Aman's/ pappu/logiclife and others core member's dream...its OUR dream, and its not fair that in spite of knowing the time and money spent by the core members we donot share the burden.
So here is what I am thinking, there are 21000+ members of which I think 10,000 can be considered the real people (I am sure there are more..but a real conservative estimate) if we all pitch in $10 for administrative cost I think it would not put any dent in our pockets and this collective effort would not create a financial burden on any of the core members.
Any thoughts!
