With the good news of all numbers current, both I and my wife's dates are current and eligible for filing I485.
1. In my application, can I include my wife as spouse for adjustment of status? And In my wife's application, can I include myself as spouse?
I am trying to do this to make sure if anything goes wrong in any one of our application, I can depend on the other one.
2. If I get an EAD based on my wife's application, can we both switch jobs after 180 days and take advantage of AC21? I read in some forums that I can, but the primary application (my wife) has to work for the same company until we get I485 approved.

Congratulations and enjoy your green card! Don't worry about the priority dates not being current when yours was approved. My green card was approved in September 2007, sometime after the July fiasco wherein the PD for all categories became unavailable. Since my gc approval, I've been in and out of the US, and I hadn't had any single problem getting back in.

Everything else looks correct, except for the above...i would have guessed that there would be a lot more in between Apr 04 and Mar 05 than just 905..?
I share your concern, there were more than 905 in that period, I don't think the DOL data sheets have any data for NOv 04 to MAr 05. I'm not sure of the source of the original post...

Understandable that Economic Stimumus Package is not a federal recuring benefit. However, ITIN holders (H4s) are eligible to claim child tax credit, why not this stiumuls benefit?. They should be given this benefit if they meet residency requirement. One should contact IRS to include ITIN holders to clain this benefit.
The IRS cannot make exceptions, since it is written in the law. However, the Social Security Act does not say that the benefit has to be recurring. I did get a reply today from the SSA. They claim the stimulus payment is a tax rebate, not a benefit. However, it cannot be a tax rebate, since the law was written to allow people with no income to apply for the check. There are even instructions on the IRS website that explain how people with no income can apply for the check. I am in the process of getting the opinion of an attorney. I will update you soon.
One last thing. I recommend that any discussions you have with the SSA be in writing. The SSA manager wanted to discuss this with me over the phone, but I insisted on written correspondence, because that is the only proof you have if this ever goes to litigation. The documents I have gotten so far already contain errors and contradictions that could be helpful in a legal case.

My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

GCBY3000, I think you are right. It is not all that simple. There are many in the House who can still vote against amnesties. We shall watch and see. I suggest that no one gets too excited about this.
SInce democrats gained the contorl on house, they will wait till the next congress starts to pass releif to immigration issue. THis way, they can take the credit for it and campaign it for their next election. Republicans are stuck now. They neither want to pass it nor want it to supress. They dont want the democrats to gain the credit whatsoever. If republicans cannot pass it this year they will do everything to stop it in next congress session if they have majority in senate. It is vey comlicated and sensitive issue and we have to wait to see how the business people push the lawmakers. None other then business tycoons can make some impact with this kind of power split in senate / congress with a lame duck president for next two years.

My employer has filed second extension and due to the fees was not sent with the proper amount they sent back the application saying it has denied and sent an I-290B with it to apply for appeal, i just got a letter and my H1 was exp in Dec 07 please help what shall i do, i am in helpless state my employer is working but any help or info is much appreciated.

I agree... i dont think its wise to call USCIS about the VB fiasco... the operators are probably minimum wage paid and are reading off of a book/compter screen.. not the ppl who can make decisions.. if it werent the us govt, we would have calling up even lower paid workers in India/Philipines and hearing from them... instead of calling USCIS, please spread the word, create awareness in the political system, press and media..

we should not care whether it can be done as part of admin fix or legislative fix. Since it has come Straight from the horse's mouth (DHS secretary), I think we should bring enough attention to her to push for this fix.

I saw the danger of our time and effort being sidetracked by trying to argue whether it's a legislative or administrative fix. The new secretary has made it clear that she is willing to push for BOTH Administrative AND Legislative fix if it's deemed necessary. Our goal should be bringing enough attention to her on the pre-application issue and convince her it's a meaningful change that will help both the DHS and the applicants, so she will push for changes. Please let me know if you agree.

What we get

But if someone else requested this info broken into PD buckets by month and Year, then I think we need to use that. The letter I sent had that wording, but I never received any response yet.
Here is what we don't get
1. Break up by country - Helps folks in EB3 as ROW is not current
2. Some might have not applied for AOS for various reason like their I140 is still pending, Some companies mandate that. - This could be a small percentage
3. Break-up by PD month& year
More insight is welcome.. Pre-adjudicated cases are not approved cases. So they can't eliminate them..

From what I understand, they aren't able to get the numbers by country of chargeablility.
Its funny they are asking me to define priority date ! :)

Have a cup of coffe, it is sprint break time, I am taking my daughter out....also I am going to meet some friends over this weekend.
