    Dude,
    Rating legislators based on how they vote for the issues important to IV is a good idea. Having reviews of the legislation is a good idea, also. Only citizens and green card holders are allowed to make contributions, so IV members who are green card holders may contriobute to lawmaker campaigns. That should be tracked, too.

    FYI..
    I received my second AP renewal within 30 days of filing. It was paper based filing. In the process I lost 2 1/2 months of my previous AP approval, which was valid till August '09.
    Seems like they are processing AP very quickly.

    similar incident happened to my room-mate, may be little worse.

    The airline was aerofloat (russian) in this case.

    they boarded aircraft from bombay to ewr. aircraft started running on runway and after some unsuccessful attempts they came back to terminal. with everyone's surprise, the pilot announced that there is a techincal difficulty and unable to takeoff.

    Next flight was after 48 hours and that too from delhi. No need to say my friend spend 24 hours also at moscow airport and finally reached newark after 4 days finally. All these with no ground staff at bombay by aerofloat. Being young students, my friend and his groups helped like a coolie to shuttle all other elderly passengers bags to hotel and so forth. He is a very fair person and still doesn't blame aerofloat. He bought the return ticket for 760 with tax, where other airlines used to charge like 1200 or so.

    morale of the story: don't blame airindia for all the faults. I am sure there is lot to improve but it is not the only airline where things go bad. This is possible anywhere.

    and lastly, the OP who blamed airindia for not allowing duty free stuff bought at NJ at frankfurt - don't blame AI. It is the airport staff of FRA and not AI.

    For all those who think that only airindia is bad, go to google and search for reviews of any airline. Chances are very high that you will get such horror stories described by someone.

    The OP somewhere has an attitude that he is too important and shouldn't have any issues. Unfortunately the world is not perfect.

    Who flies on Aerofloat?

    This airlines had a pilot, who was too drunk to fly the plane. Since the pilot was too drunk, he couldn't properly announce instructions before the take off.

    When passengers complained, he said that he will not touch anything in the cockpit and will simply sit there.

    After all this, when passengers complained about this at the destination, the fly crew said that nothing like this happened and that all passengers are having a mass hysteria.

    {this is not a joke and this actually happened - try google-ing it}

    Hi,
    couple of confusing questions regarding AP (I-131) renewal using E-File. As I am using E-File first time, I would appreciate help very much.

    1. Do we need to Send the pictures along with the application first time itself or need to wait to hear from USCIS for the pictures?
    2. Reading this thread, I came out with a list of things that I need to send with my e-file application. Please correct me if I missed something or if I am sending too much.....

    a) (Color photocopy of) Biomatric pages of Passport
    b) Photocopy of I-485 (I-797)
    c) Completed application printout
    d) 2 PP ??????
    e) Photocopy of old AP ????

    I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

    This is my situation-
    I worked for 'Employer #1' from Jan-2000 to Jan-2005
    Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2

    However, I thought of changing job in 2006 and 'Employer X' offered me a job and sponsored my H1 and it got approved too, but I changed my mind and decided to continue with my current employer (Employer #2) and I am still with Employer #2. Please note my latest H1B was sponsored by “Employer X”, but I never worked for this Employer.

    Please advice-
    1) What should I send to USCIS? As I don’t have (can’t get) Employment Letter, Paystubs and W2 for “Employer X”
    2) Would you consider this as simple case or complicated?
    3) Should I hire attorney? (I self filed my 485 in July-2007)

    Service records indicate that you were granted an H1-B nonimmigrant worker classification for employment from DEC 11, 2006 to DEC 11, 2009 for “Employer X"-. However, according to the G-325a submitted with your application, you had only worked for "Employer #1" from Jan-2000 to Jan-2005 and for the "Employer #2" from Jan-2005 to the present. Please provide evidence that you were employed with “Employer X". Such evidence may include copies of: employment letter, pay stubs or w2s

    Thank you for your time and help.

    Ask your attorney to write a letter in response to RFE and explaining the situation you never took the job with employer X though the H1B transfer or new is approved, this will clear the query of USCIS. One catch, you should have maintained a continuous employment with #2 and demonstrate the same to USCIS. Good luck!

    Note H1 to L1, H4 to H1, L1 to H1 is completely different, it is change of status - H1 to H1 is not change of status, so there is no question that you recent h1 is valid and past is invalid. Get an attorney, Good weekend

    Piyushpan, you are restating what I said and putting in extra things. All 3 categories need an immigrant petition. The advanced STEM degree + 3 years people need "special labor cert" if their grad degrees are not from the US. Please re-read what I wrote earlier.

    Are you STEM exempt? if so, is your advanced degree from the US? If yes, you may not need labor cert. But remember, I am not an expert. Get a lawyer's advice.

    That was a good analysis.
    So to summarize what you are saying is the following(as per Frist's bill)

    1 People who have advanced degrees and are presently working can apply for adjustment of status(I-485) even if they don;t have a labor or a pending I-140 but they will be subject to quota to get the final approval.

    2Secondly for people who are presently studying and doing their MS they can directly apply for I-485 if they have a US job offer within one year after graduation but they will be subject to quota as well

    3Thirdly there is the category which has MS/Phd and 3 yrs of related exp.
    For this category they can directly apply for I-485 and no quota issues either.

    My question is for all these 3 categories can you really directly apply for I-140 and I485 concurrently or do you have to have a certified labor certification or pending I-140 at the time of enact ment of the bill.
    I am asking because i have an approved perm labor and I-140 and waiting to file for I-485..but my company is not doing well so i may have to restart the process all over again in the new company i join.But if i have to file only I-140 and I-485 to get the GC in new company and if this bill becomes law then that would be amazing as i don;t have to go through the labor cert process anymore..

    Can you confirm what i'm interpreting is correct?

    My I-140 is approved and already filed I-485. Finger Printing completed twice and Medical also completed. My PD is Sept 2005 filed at Texas. Texas Processing completed for I-485 shows Sept.2006. This means my processing is completed and now the PD is current can I expect the Green Cards ....what is next??

    I have a H1b with Company A. It expires in Nov 08.
    A couple of months ago I joined company B and they transferred my H1B.
    Now if I want to go back to Company A, do I need to transfer my H1B again?

    Company A has not cancelled my H1 and I am in good terms with them.

    The Crux of the matter is 'Indians discriminate Indians !!!!'. You see that everyday.....

    1.Indian embassies in US...

    Its been long forgotten that we were once the richest country in the world with a amazing history and cultural background.

    Franklin, yes, Ombudsman report includes ALL I-485 numbers, plus ALL naturalizations. Among all of them EBs are a small number.

    What I was trying to understnd by running the numbers, where does the "leacky bucket" go over time. Imagine EB category as a leacky bucket - new workers on H1Bs are getitng their documents done, that goes to adds, and approvals are being given out, that goes to substracts. If the expected new petititons being ready are more than 140K, the total bucket will grow. If it is less, it will shrink. What I am basically saying, it is between 10K and 20K less adds than deletes, so the backlog should shrink over time (not tomorrow, of course). And it will start shrinking from EB3 ROW, because that is where the unused numbers end up. By watching EB3 ROW number we should be able to tell how fast the pool is shrinking.

    Also, in the concept of the leaky bucket, it becomes essential not to lose any numbers, this is why 10K lost numbers a year is unacceptable. Personally, I think advocating number recapture is a waste of time (better off advocating quota increases), but we should be vigilant about CIS not losing numbers going forward.

    Efficiency of precessing, in my opinion, is not an issue at all, at least on the USCIS side. FBI is a different story, but even for them, it is rare that cases are stuck for more than two years. Retrogression is the real culpit - being stuck in retro for 5 years is not unusual, and this is a whole lot worse than namecheck. By the way, because naturalizations are also subject to namechecks, there is enough outrage out there that I think namecheck issue will be solved in the next year or so.
